1- For what purpose do we process your personal data?

At YODEYMA we process the personal information (Personal Data) provided to us by consumer customers for the purpose of: (i) managing the commercial relationship with the customer, invoicing, sending the product and providing the contracted service; and (ii) if the customer gives their prior consent, sending commercial advertising.

Processing shall mean any operation performed on Personal Data, whether by automated means or not, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

No profiles will be created nor will automated decisions be made with the information provided by Users.

2- What is the legal basis for processing your data?

Legitimation refers to the legal basis for the processing of personal data carried out by YODEYMA according to the purpose pursued, as explained below:

  • to) The legal basis for processing your Personal Data in relation to the management of the commercial relationship with the client is the General Data Protection Regulation, Art. 6.1.b), since the processing is necessary for the execution of the contract for the acquisition of products to which the interested party is a party or for the application at the request of the interested party of pre-contractual measures.

Royal Legislative Decree 1/2007 of 16 November, which approves the consolidated text of the General Law for the Defense of Consumers and Users, Book Two. Contracts and Guarantees (Arts. 59 – 91); Title III. Contracts concluded at a distance (Arts. 92 –127), also applies.

As well as Law 3472002, on Information Society Services and Electronic Commerce (Arts. 23 – 29).

The communication of your personal data is a legal requirement to enter into a sales contract with YODEYMA, therefore the interested party is obliged to provide the personal data, since otherwise they will not be able to purchase products on the YODEYMA website.

When placing an order on the YODEYMA website, you will be presented with the "REGISTER" option, where you will find a form to enter the required Personal Data. If you do not enter the necessary Personal Data, you will not be able to create an account on the YODEYMA website or access or use it.

  • b) The legal basis for processing your Personal Data with respect to sending commercial communications is the General Data Protection Regulation: 6.1.a) because the interested party gave their consent for the processing of their data and specifically, for sending advertising.

You may withdraw your consent to the processing of your data at any time. Under no circumstances will the withdrawal of your consent affect the performance of the contract you have entered into with YODEYMA.

3- How long will we keep your personal data?

The Personal Data provided by Users will be kept by YODEYMA, as long as the commercial relationship between the parties is maintained, and its deletion is not requested by the interested party or a legal obligation persists.

YODEYMA will adopt appropriate security measures to preserve the integrity of information and the confidentiality of personal data and prevent its breach for as long as it retains it.

The customer's bank details requested during the purchase process will not be stored or retained by YODEYMA. To complete the purchase and make the payment, the customer is transferred to an external banking payment platform. Only the payment providers will store this data for the purpose of providing their services.

4- To which recipients will your data be communicated?

Personal Data collected through the “REGISTRATION” or “CONTACT” Form will not be communicated to any other entity nor will your data be published on the YODEYMA Website; it will only be processed for the purposes set out in these privacy conditions.

Personal data will not be shared with third-party companies, except where legally required. The data collected is for the exclusive use of YODEYMA.

5- What are your rights when you provide us with your data?

Individuals who have provided personal data to YODEYMA have the following rights:

  • Right to request access to the interested party's personal data
  • Right to request its rectification and deletion
  • Right to request the limitation of your processing
  • Right to data portability

At any time, you may request access to the data and obtain confirmation regarding the processing carried out by YODEYMA.

Interested parties have the right to access their Personal Data and request the rectification of any inaccurate data or, where appropriate, request its deletion when, among other reasons, the Personal Data is no longer necessary for the purposes for which it was collected.

In certain circumstances and for reasons related to their particular situation, interested parties may request the limitation of the Processing of their Personal Data, in which case it will only be kept for the exercise or defense of claims.

Those concerned may object to the processing of their data at any time. YODEYMA will inform them of the consequences and will cease processing the data, except in cases where it is necessary by legal obligation for the exercise or defense of potential claims.

Failure to enter the personal data that is required in the order form or the contact form may result in YODEYMA being unable to provide the service you intend to obtain.

The data subject who has given their consent for a specific purpose will also have the right to withdraw it at any time, without affecting the lawfulness of the processing based on the consent prior to its withdrawal.

6- How can interested parties exercise their rights?

The interested party may exercise the rights of access, rectification, erasure, limitation, opposition and portability, by writing to YODEYMA PARFUMS S.L.U. with address at C/Felix Boix nº 7, 1st floor, 28036 Madrid or through the email address info@yodeyma.com.
